These Terms of Use (“Terms”) set forth the terms and conditions that apply to your access and use of the website owned and operated by Stephens-Peck, Inc. (“SPI”) and located at peckstitlebook.com and peckstitlebook.us (“Site”) including all subsidiary webpages and access and use of the services available thereon (“Services”). This Site and its contents are protected by copyright of Stephens-Peck, Inc. ©1940-2023. All rights reserved.
By using or accessing any portion of the Site or its Services, you agree to the Terms below. If you are an employee or representative of a business, you represent you have the right to agree and do agree to these Terms on behalf of the business.
- Membership – Peck’s Title Book Online subscribers (“Members”) may access state title, registration, and driver license information (“Content”) by computer, phone, or other Internet-connected device. During your membership, we grant you a limited, non-exclusive, non-transferable right to access the Service and view Content through our Site. No right, title, or interest shall be transferred to you. You acknowledge that all Services and Content contain copyrighted material and other proprietary information. The Member who created the account and whose payment method is charged is responsible for any activity that occurs on the account, even if that activity is not by the Member or without Member’s knowledge or consent. Member may not share account information (except with an authorized account administrator), whether intentionally or unintentionally; or use another Member’s account. If you fail to log out of a device, subsequent users may access the Service through your account and will have access to your payment information. Immediately notify SPI of any suspected or actual unauthorized use of your account or breach of security. Members are responsible for updating and maintaining the accuracy of the information provided to us relating to your account. We may terminate or restrict a Member’s use of our Service if these Terms are violated or if Member is engaged in illegal or fraudulent use of Service. SPI is not obligated to credit or discount a Member for holds placed on the account by either a representative of SPI or by the automated processes of our Site. If SPI terminates or restricts a Member’s use of our service, prior to the end of any membership period, for violation of these Terms, Member is not due any credit, discount, rebate, or the like for any membership fees already paid.
- Service – To use our online Service, you must have internet access and a PDF document viewer installed on your device. Content is for your personal use only and may not be used other than for review purposes. Some Content is available for downloading and offline viewing. A Member may make a copy in paper form for personal, noncommercial use provided the Member includes all copyright notices that appeared on the original and a notice indicating that SPI is the source of the material. All other uses are prohibited. Content and Services, including the organization, layout, arrangement, and design elements of the Site and each page of the Site, and any and all Intellectual Property relating either directly or indirectly to the Service and Content, including but not limited to patents, design rights, copyrights, trademarks, service marks, database rights, trade-secrets, know-how, and all derivative works thereof “Intellectual Property” are and will remain the property of SPI and are protected by United States copyright, trademark, and other applicable intellectual property laws. You agree not to reproduce, transmit, display, distribute, publish, license, create derivative works from, offer for sale, or use Content and information contained on or obtained from or through our Service. You may not in any manner attempt to obtain any right, title, or interest, by registration, patent, copyright, trademark, or otherwise in or to such Intellectual Property or any derivative thereof. You shall not take any action that jeopardizes, limits, or interferes with SPIs ownership of or right to use the Intellectual Property. Unauthorized use of Content may violate copyright, trademark, privacy, publicity, communications, and other laws, and any such use may result in the suspension or termination of these Terms, your personal liability for infringement, false advertising, unfair competition, including potential criminal liability, and may subject you to monetary fines, penalties, and damages.
- Billing and Cancellation – The fee for Service will be charged to your payment method on the date ordered. An automatically recurring subscription will renew each set billing cycle. To see your next payment date, login to your Account page and navigate to the Subscriptions tab where you will see an expiration date for your subscription. The expiration date listed there is the date your subscription will renew. You may update your payment method or an expired card by going to your Account page and navigate to the Subscriptions tab and click the “Update” link on the far right of the subscription. You must cancel a recurring subscription prior to renewal in order to avoid billing of the membership fees for the next billing cycle. To cancel an automatically recurring subscription, please go to your Account page and navigate to the Subscriptions tab and click the “Cancel” link on the far right of the subscription. This will cancel any future billings for the subscription. There are no refunds or credits for partially used membership periods. Following any subscriber cancellation, however, you will continue to have access to the Service through the end of your current billing period. We reserve the right to change our subscription plans or adjust pricing for our Service at any time as we may determine in our sole and absolute discretion.
- Disclaimers and Warranties and Limitations on Liability – In the preparation of the Services contained on this Site, SPI has endeavored to make that Content as complete and accurate as possible. All references contained in these publications have been compiled from sources believed to be reliable, and to represent the best current opinion on the subject. Although our Site includes links to other websites, SPI takes no responsibility for the content contained on those other sites, nor does it exert any control over those other sites. THE PECK’S TITLE BOOK AND ALL CONTENT ASSOCIATED THEREWITH ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. SPI DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. SPI SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF APPLICATIONS, INTERNET-READY DEVICES, OR SOFTWARE (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE). IN NO EVENT, SHALL SPI OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, OR EMPLOYEES BE LIABLE (JOINTLY OR SEVERALLY) FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER. NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.
- Miscellaneous – These Terms shall be governed by and construed in accordance with the laws of the State of Utah without regard to conflict of laws provisions. These Terms do not limit any consumer protection rights that you are entitled to under the mandatory laws of your state of residence. SPI is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send us in perpetuity without compensation, acknowledgement, or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing, and marketing products and creating, modifying, or improving the Service. If any provision of these Terms shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect. We will send you information relating to your account (e.g. payment authorizations, renewal reminders, invoices, changes in password or payment method, confirmation messages, notices) in electronic form only. You agree that any notices, agreements, disclosures, or other communications sent electronically will satisfy any legal communication requirements, including that such communications be in writing.
- Changes to Terms of Use and Assignment – SPI may, from time to time, change these Terms. Such revisions are effective immediately; provided however, for existing members, such revisions shall, unless otherwise stated, be effective 45 days after posting. We may assign our agreement with you to any affiliated company or to any entity that succeeds to all or substantially all of our business or assets related to the applicable Service.
